In general, if you can't remove the excess HSA contributions, there is a 6% excise tax. If you can't withdraw the funds then you must mark the button, 'No, I'm not going to make this withdrawal.'

Are you contributing this year at all to the account? If you are contributing this year, you do have until the due date of the return (including extensions) to withdraw the excess contribution plus any earnings on the amounts, and avoid the penalty tax.
