I am recently divorced and don't get to claim my daughter as a dependent this year. I am responsible for 100% of her childcare costs. My company offers FSA for dependent care and i would like to use the pretax deduction. Can I opt into the FSA even though I don't get to claim her on my taxes? She does live with me 1/2 of the year.
