It is possible.  Let's check the rules.  

 

You can claim your boyfriend's child only if he is not required to file a tax return and you meet all the following rules as a Qualifying Relative:

 

  • The dependent is not claimed by another taxpayer.
  • Gross Income: Dependent earns less than $4,200 in 2019.
  • Total Support: You provide more than half of the total support for the year. - Support Test
  • Member of Household or Relationship: You must live with the dependent all year.

If he is required to file a 2019 tax return, you cannot claim his son even though he forgoes his right to claim him.

Once he qualifies as your dependent, you must meet the following requirements to claim the Dependent Care Credit:
