Only the custodial parent can claim the child and dependent care credit, no matter who claims the children as dependents. The custodial parent is the one with whom the child spent the most nights during the year. If you are the custodial parent you can claim the child and dependent care credit for expenses that you paid, provided that you meet the other requirements for the credit.
