I have elevated this issue for further review. In the meantime, you can mail Form 8283 to the IRS with a Form 8453 transmittal, and send a copy of both forms to the California FTB if they ask for it. 

 

I know that I have had a Form 8283 in my return in the past and California didn't ask for it. I do see that this issue has been raised before here in the Community.
