Q. Are the property tax and interest on a mortgage jointly paid by our daughter who lives in it deductible. Are the prop tax and interest we pay deductible?
A. Yes.
You appear to meet the rules, which are:
- You are legally obligated to pay it
- You actually pay it.
Real estate taxes are deductible on any property you own. Mortgage interest is only deductible on your primary residence and one "second home". A home you own, that is occupied by family, qualifies as a second home.
