are you the custodial parent?   

from an income tax standpoint:

it's the custodial parent who can claim the children despite a court decree saying otherwise.

for the noncustodial parent to claim the child the custodial parent is supposed to furnish the other with form 8332 that is to be filed with their return.

 

what if one parent is violating the court decree and not furnishing the form, the IRS doesn't care it has it's rules so that only leaves the other parent with legal options.  the IRS will not tell you if your spouse claimed both.
