Q. I pay taxes to NY instead of NJ. How do I fix it? Since NY won't easily refund me. I know that it's not easy to prove to NY. What do I do?
A. 1. Try to get your employer to stop NY withholding, per @TomD8 's advice.
2. File the NY resident return and hope for a refund. If they reject it, you'll get a chance to object to the rejection (explain the circumstances).
Note that if you claim a refund, on the NY return, you do not claim a credit on the NJ return (because you will not have paid any NY tax if you get a full refund). If you still fail to get a NY refund, after an appeal, then you'll have to file an amended NJ return to claim the credit for taxes paid to another state.
