Q. So I would have to file in California and Nevada is this correct?
A. No. NV does not have an income tax.
The real questions are: how much of your salary is considered CA source income and do you file as a CA full year resident or part year resident. Normally, in a moving situation, you would file a part year resident return and only pay CA tax on the wages prior to the move.
But, you say "I am moving back to California in a few weeks".
That complicates things, as it sounds like you only had a temporary assignment in NV. If that's the case, you were considered a full year resident of CA and owe CA tax on all your income, for 2022. It may hinge on whether or not you completely abandoned your CA domicile. If you claim part year resident, the erroneous W-2 is going to make it difficult to convince the CA tax authority.
