This does not appear to be correct. The 760 2022 instructions do not include this statement you quoted: "You may claim this deduction on your Virginia return only if you were eligible to claim a credit for child and dependent care expenses on your federal return." What is the basis for this guidance that the Virginia deduction can only be claimed if a taxpayer qualified for the federal credit? I cannot find any official/actual source for it.
