California Form 593
My mom passed away and her paid-off condo was included in her trust for my brother and I. My brother was the fiduciary trustee. He said the escrow officer told him to hold back some money for state taxes. My brother's CPA did my mom's 2019 final complex trust California Fiduciary Income Tax Return, and my mom's 2019 final U.S. Income Tax Return for Estates & Trusts. I was given a copy of the 2019 593, along with copies of the 2019 Schedule K-1 (541) for the State, and the 2019 Schedule K-1 (1041) for Federal along with all the other paperwork to be entered. I had to do these as mailed amended returns. The total refund amount is $8,325.00 to be split 50-50. The problem is when I enter the amount from Part III, #5, which shows the whole amount of $8,325.00, the CA Refund on my return shows $8,325.00. This is not correct. My 50% is $4,161.00. My questions are (1) Was the Withholding Agent correct in sending the 593 to my brother's CPA with the amount of $8,325.00, or should the 593 have showed only my 50% amount of $4,161.00? (2) Am I allowed to over ride (edit) the amount on Part III, #5? I will be attaching the original 593 to my return. Also, Part II, Seller/Transferor Information, defaulted with my name and my husband's name, and I can't over ride (edit) it and put my mom's name and her Trust along with the date, and my brother's name as Trustee. I don't know what to do. I don't want to have my amended return rejected. You have always helped me in the past which I am very grateful for! Thank you.
