State tax filing
An active-duty member whose SLR is NY will have their active-duty income taxed unless they are a nonresident for tax purposes:
1. Do not maintain a domicile in NY
2. Were not physically present in NY for more than 30 days.
3. Do maintain a domicile in another state. However, if they live in barracks, they do not maintain a domicile, and their active-duty is taxed.
How does an active duty military member whose SLR is NY exempt their Active Duty Income? Must file a New York nonresident return (TurboTax has screens to exempt the income).
