After you file

If the IRS did disallow your EIC, you may need to file Form 8862 before the Internal Revenue Service allows you to use the credit again.

IRS Form 8862Information To Claim Earned Income Credit After Disallowance, is a form which a taxpayer must complete and attach to their federal income tax return if:

  • their Earned Income Credit (EIC) was reduced or disallowed for any reason other than a math or clerical error for a year after 1996, and 
  • they want to take the EIC and meet all the requirements
