After you file
@Mariacaropis , as I understand from your post --
1. you filed jointly ( I am assuming that your Name/ SSN was shown first and that you are a resident/ citizen ) along with a request for his ITIN and a statement that he is to be treated as a resident for the year ---YES?
2. You have at last received the ITIN for him but the return is still in limbo -- no refund issued. And since your state is awaiting IRS disposition of the file, they are also waiting.
In such a case -- (a) call or visit the local IRS office and they should be able to tell where the processing is ; (b) contact the state tax office and also try to get this resolved -- show them the ITIN application disposition; (c) do not amend / refile the return with his ITIN or SSN -- it will just create more confusion. (c) if after chasing this with the IRS , you do not get a satisfactory answer, then with all the documentation of efforts to get this thing resolved , approach the local tax-payer advocate's office -- they will not get involved unless you can show that you have tried to normal channels to get IRS to resolve this .
