After you file
The first thing to understand is there are guidelines set up by the IRS and they expect everyone to follow them. The custodial parent gets the Head of Household filing status and the EIC. The person that claims dependency gets the Child Tax Credit.
You, as the custodial parent, need to file your return correctly and claim the EIC, regardless of what she did. The IRS will see two competing returns and will settle the issue.
