Based on what you’re describing, this seems like a classic instance in which the IRS’s Taxpayer Advocate Service could be of assistance.

You state that you’ve “I’ve contacted a tax asst;” this doesn’t sound like the Taxpayer Advocate, but even if it was, you should contact them again.
