If your employer withholds tax then they must forward that withheld money to the IRS and SSA so that it can be applied to and credited to your account.  That is not possible for an employer to do without an IRS issued EIN number.  It is no legal to withhold money and then just keep it.

 

Ask your employer what they did with your withholding without a EIN.

 

If the employer is uncooperative then I suggest contacting the IRS that can contact the employer on your behalf (and impose fines on the employer for not complying to the tax laws).

Call the IRS. Taxpayers who are unable to get a copy from their employer by the end of February may call the IRS at 1-800-829-1040 for a substitute W-2. The IRS will send a letter to the employer on taxpayers’ behalf. When they call, taxpayers need their:

  • Name, address, Social Security number and phone number.
  • Employer’s name, address and phone number.
  • Employment dates.
