If you are entitled to claim the child and you want to do so, you should claim him and mail your tax return in. The IRS will process your tax return and adjust the tax by taking him off the return.
You will get a letter explaining why your tax return was adjusted. You can protest the adjustment by explaining why you should be allowed to claim your dependent and mailing your statement to the IRS in response to their letter.
They will then launch an investigation and if you are correct, eventually they will refund you the additional tax.
