I'm not sure, based on the notice and the fact they withheld it from a refund you were due within the three year timeframe, you "could" be entitled to have it refunded to you. But I wouldn't expect it, as I'm sure that the notice you are responding to is most likely not the first one you received on the matter. But it could be.
