The answer is strictly for the personal portion of the tax return and itemized deductions. Estate planning legal fees would not be an allowable deduction.

 

Tax preparation fees are no longer a deductible expense for the itemized deductions on the federal return due to the Tax Cuts and Jobs Act (TCJA), which is in effect until 2026. As far as business returns or rental activities a portion of the tax preparation fees that would be attributable to that portion of the return can be deducted on that part of the expenses for those activities. (Schedule C or Schedule E).
