@leesm99pikl , if you are in this country ( physically present in the USA ) then before anything you MUST renew your passport before applying for ITIN --- without a valid passport it is unlikely that IRS will grant you an ITIN. Also I am not sure I understand why you need an ITIN if you are present in the USA without a valid Passport -- please can you clarify the situation for me?
If you are not physically present in the USA and need the ITIN only for filing a return ( Non-Resident Alien ) for recognizing US source income, then yes, all you need is to prove your identity and instead of a passport you may need to use the services of a local agent certified by the IRS for such purposes. You can also visit the nearest US consulate and they generally can help in this .
