One correction on the steps:

  • You would attach your return to the Form, W-7 requesting the ITIN for your wife and mail to the instructions on the W-7 Form.

To answer your questions:

Question 1:

You would not need to send in any supporting documentation with your return but should maintain the calculations for your records.

To enter your foreign income, you should:

  • Enter foreign income in the Search Magnifying Glass in the upper right hand corner of your screen.
  • Select Jump to foreign income.
  • Answer the questions on the screens.

Question 2:

Attach a statement, signed by both spouses, to your joint return for the first tax year for which the choice applies. It should contain the following information.

  • A declaration that one spouse was a nonresident alien and the other spouse a U.S. citizen or resident alien on the last day of your tax year, and that you choose to be treated as U.S. residents for the entire tax year.
  • The name, address, and identification number of each spouse.
  • The statement does not need to be notarized just your signatures.

Question 3:

There three ways to have submit your W-7.

  1. You can mail in the W-7 return with your wife’s passport.
  2. You can look up the address of Certified Acceptance Agents on the IRS website. The can certified that the passport and Visa is legitimate. They will make a copy of the passport and they will mail the W-7, your return, and a copy of the documents to the IRS. See CAA Listing.
  3. You can schedule an appointment with your local IRS office for them to review the documents.

Question 4:

You will need to mail in your return and all documents that have withholding on the form. These would be W-2, 1099-R, etc.  You do not need to send in any documents on your calculations. You need to keep the calculations in your tax records.
