Here is my situation.
- Living in USA for ~15 years on work visa H1b
- Got married to non US person about 2 years back in 2012. My spouse has never been in the country and will not be in the country for foreseeable future.
- Filed in 2012 as Head of the house hold with my parents as my dependent.
-You mentioned that one can choose to treat non resident spouse as a US resident (refer page 9 of Pub 519 – Nonresident Spouse Treated as a Resident). Can this be applicable in my situation for filing return in 2013?
- if yes, would I need to submit W-7 along with my spouse's passport/visa and birth certificate ? Can I submit copies of these documents instead of original ?
