Here is the scenario of mine:
- I am holding H1B visa and working for client in CA-USA from 1st July 2013 to till date. Currently in CA-USA. This is my 1st time in US.
- I got married before I came to USA (in year 2010).
- My wife is not having any income sources in India and she never been to USA and she don't have SSN/ITIN. I am also planing to bring my wife(on H4 visa, yet to start process of H4) to USA in March,2014.
- Also, I went to India on vacation on 20th Oct 2013 and back on 5th Nov 2013.
Here my questions:
- Do I need to file 'Married filing separately / Married filing Jointly'?. Which suite better in my case.
- Do I need to file as 'Non Resident Alien /Resident Alien'?
- Is it possible to file 'Married filing Jointly' in my case.
- What is 'first year choice'. Would this be applicable to me?.
- For applying ITIN to my wife, does she requires to be present in US?. (I think, she is not eligible for SSN as she is not US).
- Is it possible to file returns using TurboTax in my case?
