You can be. The penalty depends on the amount of income you (or your household) make. A family at the lower income levels are often times not subject to the penalty. Two of the exemptions from the penalty are:
- The lowest-priced coverage available to you, through either a Marketplace or job-based plan, would cost more than 8.16% of your household income.
- You don’t have to file a tax return because your income does not meet the filing requirements.
