I assume that you are asking whether you can or cannot claim your husband as a dependent.

You can claim your husband if you meet certain requirements. However, it is usually not the best option.

First, you can claim your spouse as a dependent if the following applies:

  1. You are filing using the married filing separate filing status.

  2. Your spouse doesn’t have any income or a tax return filing requirement.

However, you can get the same tax benefit by filing using the married filing joint status. The married filing separate filing status has the least advantageous tax brackets, your child tax benefits are lowered significantly, and you loose the earned income credit. You will get a much better refund if you file with your husband using the married joint status.
