It depends. If you feel that you have the proof that she lived with you at least 183 days and you wish to claim her, you will need to mail in your return. From there, the IRS will send out correspondence to you and the other party who claimed her, asking for proof on the claim. The situation can be a bit complicated, because, since her mother died last year, the IRS will consider your daughter as having lived with her mother all year if she lived only with her up to that point, and someone filed your ex's return as a deceased taxpayer claiming your daughter.
