We have one child and the mother is claiming the child as her dependent but I will be paying for daycare via FSA. Would I need to claim the child as my dependent to receive the tax benefit for FSA dependent care? I know we both can't claim the child as our dependent.
We live in CA and will be filling separately. Please advise.
