No, you can't file as "Single" if you were legally married by 

December 31, 2025. 

 

You must choose between 

  • Married Filing Jointly (MFJ) or 
  • Married Filing Separately (MFS). 
  • If you file as single while you are‌ married can lead to 
    • IRS penalties, 
    • Back taxes, and 
    • Denied credits.
