You don't change to Head of Household (HOH) just because your spouse is not filing.
You can file HOH only if you are considered unmarried for tax purposes and meet the HOH requirements:
- You lived apart from your spouse for the last 6 months of the year
- You paid more than half of the costs to keep up your home
- A qualifying person lived with you for more than half the year (e.g. child or other dependent)
- You file a separate return
If any of the above are missing, you may not file as HOH.
