I didn't think of asking you what state you live in. If you live in a community property state, filing as married filing separately might not solve your problem. Half of your husband's income would be considered your income and would have to be reported on your separate tax return. If your husband refuses to cooperate, you might have to consult a tax lawyer.
The community property states are Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin.
