The tax agent handling my case clearly failed to file a required form, despite my providing all the necessary information to do so. She claimed that the form wasn't needed and advised me to only file an FBAR online, which TurboTax does not handle. After my return was submitted and accepted, I later realized that Form 8938 should have been attached to my federal tax return. I paid for full service but did not receive it, I have to audit my self basically and I am requesting a refund. Additionally, I was informed that any amendments can't be made until I receive my refund, which is concerning since I’ll miss the April 15th deadline. To make matters worse, I was advised not to file the FBAR in the meantime, which could expose me to serious civil and criminal consequences.
