The 39.99 fee is an additional service charge for "paying out of the Fed refund." A state return preparation fee is 29.99. If paying out of the Federal refund the fee would be 29.99 + 39.99 = 69.98, plus possible sales tax..
If paying upfront with credit/debit card or prepaid debit card, the fee is 29.99 (plus possible sales tax.) i.e., there is no service charge when paid upfront.
