Get your taxes done using TurboTax

You have had a lot of input but there is a lot of-if you are a CA resident in there.

NY is clear - you rented a place and worked, filing NY resident return.

CA is the problem one -nobody is sure of all the circumstances. You either don't need to file CA or you need to file CA return of some type.

  • If you kept your CA license, voting, etc, it looks like you intend to live in CA.
  • If you had actually moved to NY, you would have a new license within 30 days of moving there, as required by law for a resident. See Driving in New York State - NY DMV.

You say that you moved out of CA in 2023 but worked remotely, from ?(NY?), in 2024 earning income at the CA address. You should probably file a CA return to prevent issues in the future. The income is being taxed in NY and CA is giving you a credit for the NY income and tax. You shouldn't be seeing much of a difference, if any,  based on resident, part year or nonresident, when NY is taxing it all.

Which leads to.....

  • NY resident
  • if CA has your license then you need to be able to prove that you have established residency in NY and intend for that to be your home - lease, social events, etc while disregarding the laws of both states. CA and NY expect the laws to be followed and used in these situations. Going forward in life, check state rules when you move.

You can file a part year CA, a CA nonresident or CA resident depending on what you established when. Take a look at the CA filing requirements and think about what you have and can prove. It seems reasonable for you to be able to prove part- year resident, probably non-resident, and clearly resident.

Clear as mud and we can only give you the laws. The laws must be interpreted and sometimes extrapolated, as in your case. Look around and think about where you have been, what proof you have of NY residency, etc. Then make the best choice and file. You may have transactions for social activities in NY, lease, etc.
