Sadly, the HSA bank is simply wrong. This is because you can have medical expenses paid by her FSA, and there is no way for you to opt out of it. Therefore, this is a conflict, even though you may choose not to avail yourself of those dollars.
HSA custodians and payroll departments as a rule don't understand the rule of the HSA process very well. In part, that is because the IRS instructions can be vague and simply don't address many situations..
