The IRS will intervene if the child is claimed on two separate tax returns. If parents can't agree on who gets to claim a child as a dependent, the IRS will decide. The IRS will usually allow the claim for the parent that the child lived with the most during the year. It is hard to say how long it will take. You will probably have to file by mail, but please see the IRS info below. You may be able to get the PIN and e-file in a shorter time period than filing by mail.
Beginning in 2025 (tax year 2024), the IRS will start accepting tax returns even if a dependent has already been claimed on a previously filed return provided that the primary taxpayer on the second return includes a valid IP PIN. For more information, see this IRS News Release.
