1. A NY return is not required for nonresident when the income is less than the standard deduction which can be $3,100 or $8,000. You know that he qualifies and is not required to file this year. See Nonresident forms 

2. NJ taxes retirement income you set aside while NY does not so the income between the two states is different in calculating. The program will automatically take all state income over to NJ to be taxed. You will enter the full NY amount on the w2 and the remainder that belongs to NJ.

For example:

  • Fed earn $80k
  • NJ earn $83k
  • NY earn $12k

Your w2 entry would have: 

  • federal where it belongs, 
  • the NY of $12k and 
  • NJ of $83-12NY =$71k on NJ state line
