Thank You for the quick response, the lawyer did provide us a Statement of Account and it does indicate that attorneys do not give tax advice or purport to be tax experts but the attorney fees and costs should be deductible as an "above the line" deduction and to confirm with a tax advisor.

The settlement was for action for discrimination and harassment under the California Fair Employment and Housing Act
The only box that has a dollar amount on the 1099-MISC is number 3 "other income "
