Employer issued incorrect 1095-C
Employer offered a health plan that was not compliant with Affordable Care Act. It was a low cost "fixed indemnity" plan with no limits on out-of-pocket cost. The insurance company confirmed it was not compliant and said it would not make us ineligible for subsidies under the ACA. We got insurance through the marketplace and received subsidies. Then the employer issued a 1095-C with "1A" entered in box 14, which means they are claiming we were offered coverage that conforms to the ACA. I brought this to the attention of the employer, and they ultimately agreed that the plan they offered did not conform but they are refusing to issue a revised 1095-C. I contacted the IRS Taxpayer Assistance Center and they said my only option was a civil suit agains the employer. There must be some Federal agency that would be interested in enforcing compliance with the Affordable Care Act. HELP!!
