When you file jointly there is only one refund. It's not your husband's refund or your refund, it's a joint refund for the two of you. The entire joint refund can be taken to pay certain debts that either one of you owes.


You can prevent your share of the joint refund from being taken for your husband's debt by filing for injured spouse relief (Form 8379), which you can do with TurboTax. You are the injured spouse.


It's not clear exactly what you mean by "unemployment fraud." If the fraud involved false reporting by your husband on your joint tax return, and you did not know about the false reporting, you might be eligible for innocent spouse relief. But if the fraud did not involve false reporting on your tax return, you want injured spouse relief, not innocent spouse relief.
