No, your Dad will not be in trouble for not filing a tax return for working one day.  There are criteria to determine if a person needs to file a tax return.  Assuming you are inquiring about 2021 since you said that he will have two W2’s for the same company, here are the filing requirements for 2021

For 2021, you don't need to file a tax return if all of the following are true for you:

  • Under age 65
  • Single
  • Don't have any special circumstances that require you to file (like self-employment income)
  • Earn less than $12,550 (which is the 2021 standard deduction for a single taxpayer)

For individuals over 65, the gross income threshold is higher ($14,240).

If you determine that your Dad needs to file a tax return for 2021, you still can file a tax return for him.  Just as Bsch4477 indicated, you cannot report income from a 2021 W2 with income from a 2022 W2 on a 2022 tax return.
