You state that the child in question has already been claimed but you believe you are entitled to the credit.  There are specific rules as to who can claim a dependent on their tax return, which I will give you a link to look at below.  Generally, to claim a dependent, they must live with you for more than 6 months of the year and you must provide more than half of their support.  Lacking evidence to the contrary, the custodial parent has control of the dependency claim and credit.

 

In your case, since the dependency has been claimed by another, you need to contest this with the IRS.  Also, you need to fill out and maintain Form 8332, Release/Revocation of release of claim to Exemption for child by Custodial Parent (link to form below)
