Take a look at the 1099-MISC and see who is listed as the Payee. If its both of your names, you can split the amount you report on each tax return. If it's only in one name, report it on the tax return that it is reported to.
California is a community property state so to properly file your tax return, you will need income information from your spouse to complete your taxes.
