Hi mbmche,

 

  Thank you for reaching out to Intuit's TurboTax Ask the Experts Event!  You are not required to claim your 19 year old son as a dependent.  You might not even be able to claim him once he turns 19 years old.  The rules for claiming a qualifying child are:

 

To meet the qualifying child test, your child must be younger than you and either younger than 19 years old or be a "student" younger than 24 years old as of the end of the calendar year. There's no age limit if your child is "permanently and totally disabled" or meets the qualifying relative test.

 

  You may be able to claim your son as a qualifying relative if he meet this criteria:

 

Qualifying relative

  • Do they live with you? Your relative must live at your residence all year or be on the list of “relatives who do not live with you” in Publication 501. About 30 types of relatives are on this list.
  • Do they make less than $4,400 in 2022? Your relative can't have a gross income of more than $4,400 in 2022 and be claimed by you as a dependent.
  • Do you financially support them? You must provide more than half of your relative’s total support each year.

In all cases, to claim someone as a dependent on your tax return, you can't be claimed as a dependent on someone else’s return.

  If you claim your son as a qualifying relative you may be able to get the "Other Dependent Credit" of up to $500.
