F-1 to H1B Married Filling Jointly
Hello experts.
I have been doing some reading and wanted to use TurboTax next year for my taxes, however here is my situation:
- F1 from January 2019 to May 2022 (OPT from Jun 2021 to May 2022) (3 years, 5 months)
- H1B from July 2022 onwards (5 months at the end of 2022)
- Got married Dec 2021, wife is in the US under H4
I will not meet the Substantial Presence Test due to not being in the US for more than 183 days in 2022 (I was traveling and entered the US under H1B on July 6, 2022, so only 179 days inside the US at the end of 2022) and the days under F1 do not count
I understand I would have to file as a dual-status alien using a combination of Sprintax for income from January to June 2022 (1040NR) and Turbotax for income from July to Dec 2022 (1040)
I am not clear on a couple of things:
- If hypothetically I made $12.000 in 2022 will BOTH forms show the 12K for the year or will the 1040NR show $5K and the 1040 $7K, totaling the 12K for the year?
- I want to file as Married filing jointly, my wife already has a SSN. what other forms do I need to include?
- Do I need to file any other forms to specify I want to file as a dual-status alien?
