My son (5 years old) goes to a private school for Pre-K education, can I claim his private school tuition as child care tax credit?

Are you asking about the federal childcare credit or a NJ credit? If you are asking about the federal childcare credit, you can claim the credit if your child attended preK so that you (and your spouse if you are married) could work.
