Former spouse receives a portion of a member’s military retired pay-court ordered/spouse not eligible to receive -1099R

I am a former spouse of a retired military member. The court ordered my ex-spouse to pay me a portion of his military retirement pay every year. I do not receive a 1099-R because I don't meet the DFAS guidelines to receive a 1099-R.   This payment is not considered alimony.

 Please provide guidance on reporting this income on my taxes.

Since the money is not considered alimony, it would be considered pension income by the IRS. You can report that by entering a substitute Form 1099-R in TurboTax as follows:

 

  1. Find the Retirement Plans and Social Security menu option
  2. Start or Update IRA, 401(k), Pension Plan Withdrawals (1099-R)
  3. Choose Add Another 1099-R
  4. Choose I'll type it in myself
  5. Go to the personal income section of TurboTax 
  6. On the screen that says Tell Us Which 1099-R You Have choose I need to prepare a Substitute 1099-R

You won't be able to e-file your tax return unless you enter a federal ID number on the form 1099-R entry. You can use the one on the form your ex-spouse receives if he or she makes it available to you.
