Starting a new business with a partner

Before forming a LLC etc when starting a first time small business, is it better to have someone as your partner or employee for taxes?

 

If I’m getting paid from a client, and then giving their portion to my partner/employee, would that money count as my personal income in addition to theirs?

 

What would be the best way to handle this? Thanks!

That depends. Have they made a capital contribution and listed as such in the Articles of Organization?

 

If so, they are a partner, regardless, and partners cannot also be employees of the partnership.

Starting a new business with a partner

with a partnership generally form 1065 would be require (Turbotax Business for the 1065 either online or desktop versions but desktop is only available for users of Windows 10 or above) to be filed to report and split the income between the partners.  I think you need guidance in this matter so consult a tax professional before the end of 2024. things can be done in 2024 but once 2025 arrives it may be too late.  A 1065 is due by 3/15 of the following year. Late filing penalties can be around $200/month/partner.
