Me and my gf live together with our son all year. She claimed him as a dependent, and when I fill my taxes, it says i qualify for non-dependent eic/dependent care

I'm confused because a CPA told me the way i filled it is fine but then i read here and everyone else is saying to take off the dependent completely

Your CPA may have misunderstood something.

If you all live together, only ONE of you should have the child listed on your tax return.  You are answering the questions in such a way that the program thinks you do not live with your girlfriend that you a Custody Agreement allows her to claim the child, but that is not the case.  Again, only ONE of you should have the child listed on your tax return.
