Should we claim our son as dependent when he is working but living with us?

  • My husband claimed me and my son who is 21 for his dependents for income tax. Early of 2016 my son and his girlfriend is living with us, they are also expecting a child this November 2016. My son works for almost a year now. What to do when it comes to filing taxes within our family. Is my husband should claim my son? Even my son has his own work and will start his family?

Should we claim our son as dependent when he is working but living with us?

If your son is not a full time student under the age of 24 and has gross income of $4,050 or more then no one can claim him as a dependent.

As a spouse you cannot be claimed as a dependent.  You would file a tax return with your husband as Married Filing Jointly where both of you would have a personal exemption of $4,050 each.
